INFORMATION TEXT ABOUT THE POLICIES ON THE PROTECTION AND PROCESSING OF PERSONAL DATA
ARTICLE 1: DATA CONTROLLER
a. In accordance with the Personal Data Protection Law No. 6698, the European Data Protection Regulation and other relevant legislation (“KVKK”); ERBEK GROUP SEFA NURSING HOME ELDERLY CARE AND REHABILITATION CENTER INC. (Referred to as “Sefa Nursing Home”.), located at Kırkkonaklar Mahallesi 323.cadde No:9 Çankaya-ANKARA and registered in Ankara Trade Registry with registration number 220295; is the legal entity that acts as a Data Controller and provides residential care activities with nurses (including the activities of nursing homes with elderly homes, activities of nursing homes with only a minimum level of nursing care, and Rehabilitation center management and residential care activities.
b. Within the scope of this Clarification Text, the Data Controller, whose information is given above, may be referred to as Sefa Nursing Home. Your personal data may be processed by Sefa Nursing Home within the scope described below and in accordance with the legislation related to the Constitution.
c. The physician providing the service provided shall act as the Sefa Nursing Home Data Supervisor, to which the employees providing the healthcare and elderly care services are affiliated.
d. In this Clarification Text, detailed information shall be provided about the purposes of processing your personal data by Sefa Nursing Home.
ARTICLE 2: OBTAINING PERSONAL DATA
Your personal data is provided by Sefa Nursing Home;
a. Carrying out Nursing Home and Elderly Care services,
b. If you apply for Nursing Home and Elderly Care Services offered by Sefa Nursing Home and request information and documents,
c. Oral, written, visual or electronic media, call center, webpage, mobile phone applications, verbal, written and similar channels are obtained through the posts you have shared.
ARTICLE 3: PROCESSING OF PERSONAL DATA
a. Your special quality personal data and general quality personal data, especially your health data, can be processed by Sefa Nursing Home in a limited and measured way in connection with the purposes specified in this article, including but not limited to the following:

e. Your private health insurance data and Social Security Institution data for the realization of Nursing Home and Elderly Care Services (activities).
f. If you visit Sefa Nursing Home, your video footage that is kept for security and inspection purposes.
g. Your Health Information: Obtained during or as a result of medical diagnosis, treatment, rehabilitation and care services, including but not limited to your examination results, laboratory results, test results, examination information, appointment information, allergy information, check-up information, prescription information. your personal data regarding all kinds of health and sexual life.
h. The information you send to Sefa Nursing Home webpages, your assumed personal data that you share at your own will through the forms you fill out.
i. If you apply for a job at Sefa Nursing Home, including the CV provided for this purpose, and your other personal data, and if you are an employee or related service provider or supplier of Sefa Nursing Home, your relevant contract, identity information, professional experience, work competencies, professional history, your personal data, if necessary, your health data and your criminal record.
ARTICLE 4: PURPOSES OF PROCESSING PERSONAL DATA
All kinds of personal data obtained by Sefa Nursing Home (including but not limited to sensitive personal data) may be processed for the following purposes:
a. Confirming your identity information,
b. Protection of public health,
c. Carrying out nursing home and elderly care services, providing rehabilitation services,
d. Budget planning and management with nursing home and elderly care services.
e. Sharing the requested information with the T.R. Ministry of Family and Social Services, T.R. Ministry of Health and other public institutions and organizations in accordance with the relevant legislation.
f. Planning and managing the daily operations, internal functioning of Sefa Nursing Home.
g. Managing of Sefa Nursing Home,
h. Measuring, increasing and researching elderly/patient satisfaction.
i. Supply of medicines,
j. Obtaining the identity data and personal data of the Elderly/Patient and his/her relative, who will be the addressee of the Care Service Contract, for the acceptance procedures,
k. Obtaining the identity data and personal data of the Guardian or his/her representative in case the Elderly/Patient is restricted
l. Realizing risk management,
m. Carrying out quality improvement activities,
n. Carrying out internal audits and internal analyzes in order to develop nursing home and elderly care services,
o. Sharing the requested information with private insurance companies, Social Security Institution (SGK) and contracted institutions, provided that the necessary documents are provided.
p. Planning and process improvement.
r. Performing process management for compliance with the legislation, responding to warrants from official institutions.
s. Sharing the information and document transfer requested by private insurance companies or contracted institutions within the scope of the financing of nursing homes and elderly care services, provided that they are not contrary to the legislation, and following the process.
ş. Carrying out risk management activities, system improvement, fulfillment of quality activities by the quality department and data processing.
t. Invoicing in return for the Nursing Home and Elderly care services offered and establishing relations with contracted institutions, sharing information and documents on an Elderly/Patient basis and in accordance with the legislation.
u. Marketing, promotion, activities of promotion,
v. Measuring customer satisfaction,
y. Designing special content, tangible and intangible benefits on web and mobile channels and conveying them to the target audience.
ARTICLE 5: METHODS OF PROCESSING and STORING PERSONAL DATA
Your personal data obtained, stored and processed in accordance with the relevant legislation can be stored by Sefa Nursing Home both in physical archives and in electronic media.
ARTICLE 6: TRANSFERRING PERSONAL DATA
Your personal data, within the scope of the law and other legislation and for the above-mentioned purposes, is provided by Sefa Nursing Home with T.R. Ministry of Family and Social Services, T.R. Ministry of Health and its sub-units, Social Security Institution, General Directorate of Security and other law enforcement agencies, General Directorate of Population, Turkey Pharmacists’ Association, Courts and all kinds of jurisdictions, Private insurance companies and other third parties, your authorized / our authorized lawyers and other representatives, tax and financial advisors and third parties we consult, including auditors, regulatory and supervisory Institutions, official authorities, including our business partners and other third parties to develop or carry out Nursing Home and Elderly care services for the above-mentioned purposes, provided that it is not contrary to KVKK.
ARTICLE 7: CAUSE AND BASIS
Your personal data is processed in all kinds of verbal, written, visual or electronic media for the above-mentioned purposes and for all kinds of work within the scope of activity of Sefa Nursing Home to be carried out within the legal framework.
Your personal data is collected and processed in order for Sefa Nursing Home to fulfill its contractual and legal obligations fully and properly.
Among the legal reasons for the collection of this personal data are:
a. Law No. 6698 on the Protection of Personal Data,
b. Health Services Basic Law No. 3359,
c. Decree Law No. 663 on the Organization and Duties of the Ministry of Health and its Affiliates,
d. Regulation on Private Nursing Homes and Elderly Care Centers,
e. Regulation on the Processing of Personal Health Data and Protection of Privacy,
f. The regulations of the Ministry of Health and the Ministry of Family and Social Services and other legislation are included.
As stated in the KVKK, personal data related to health and sexual life can only be collected by persons or authorized institutions and organizations under the obligation of confidentiality for the purpose of protecting public health, carrying out Nursing Home and Elderly Care services, planning and managing the financing of Nursing Home and Elderly Care services. It can be processed without seeking explicit consent and Sefa Nursing Home acts in accordance with this provision.
ARTICLE 8: DATA SECURITY
Sefa Nursing Home protects your personal data in accordance with all technical and administrative security controls that must be taken in accordance with information security standards and procedures. Risk assessments are made on a regular basis, and all employees are regularly trained on the Protection of Personal Data, information security and cyber security.
ARTICLE 9: RIGHTS OF DATA OWNER AND APPLICATION
The rights of the data owner are listed below in accordance with the laws of the Republic of Turkey and the legislation of the European Union on the protection of personal data.
